Saxon Commodities T/A Custom Blinds®, Shutters, and Awnings and trading online through the Studio Store

By accessing this website and placing an order you agree to be bound by these Terms and Conditions.

These terms comply with the Consumer Protection Act (CPA) and Electronic Communications and Transactions Act (ECTA) of South Africa.

1. Definitions

  • • “Custom Group” refers to Saxon Commodities T/A Custom Blinds®, Shutters, and Awnings 
  • • “Goods” refer to blinds, shutters, awnings, and related products and services offered by Custom Group.
  • • “Customer” refers to the purchaser or user of Goods and services.

2. Quotations and Orders

2.1 The Customer acknowledges responsibility for verifying all measurements and specifications before placing an order. Custom Group will not accept liability for errors in Customer-provided measurements.

2.3 Custom-made Goods cannot be cancelled once manufacturing has commenced, in accordance with Section 17(3) of the CPA. 

2.4 The order becomes binding upon the company only once it has been reviewed and payment received in full.

3. Pricing and Payment

3.1 If errors (e.g., omitted costs or zero values) occur in pricing due to human or online platform miscalculations, Custom Group reserves the right to correct the price and inform the Customer prior to processing the order. Alternatively the monies will be refunded and the order cancelled.

3.2 Full payment is required before dispatch unless alternative arrangements are agreed upon.

4. Delivery and Installation

4.1 Delivery and installation dates are approximate. Custom Group will not be held liable for delays due to factors beyond its control, such as supply chain issues or Force Majeure.

4.2 Risk passes to the Customer upon delivery of Goods to the nominated address. Ownership transfers only upon full payment.

5. Returns, Refunds, and Warranty

5.1 As per Section 20(3)(b) of the CPA, Goods affixed or installed are not eligible for return unless proven defective or not to documented agreed specifications.

5.2 If the Customer mismeasures or orders incorrectly, Custom Group accepts no liability for returns or exchanges.

5.3 Complaints must be lodged within 7 days of delivery or installation. Where a warranty applies, Custom Group’s liability is limited to repair or replacement. Returned products will be subject to inspection to confirm the defect. Products to be returned in original packaging and undamaged.

5.4 If a defect is found, customers must notify the company within 48 hours of delivery. The product will be inspected to confirm the defect. If confirmed a replacement or refund will be issued at the discretion of Custom Group.

5.5 A 12 month warranty is provided on all products for manufacturing defects this does not include; damage caused by incorrect installation. Wear and tear from regular use or damage caused by improper care or misuse

6. Online Transactions

6.1 Under ECTA, electronic communications confirming orders serve as legally binding agreements.

6.2 Custom Group’s online store shall prominently display the following:

  • • Full contact details, including a physical address.
  • • Terms of payment, delivery timelines, and refund policies.
  • • A cooling-off period of 7 days for non-customized products, per Section 44 of ECTA.

7. Indemnity

7.1 The Customer indemnifies Custom Group against claims arising from defective installation due to structural issues at the premises or Customer-provided measurements.

7.2 Custom Group is not liable for consequential or incidental damages, including loss of profits, arising from delays, installation defects, or incorrect product use.

8. Dispute Resolution

8.1 Any disputes shall be resolved amicably or through the Knysna Magistrate’s Court, notwithstanding the jurisdictional limits.

9. Force Majeure

9.1 Custom Group is not liable for delays or non-performance due to circumstances beyond its control, including natural disasters, strikes, or supply chain disruptions.

Notices and Amendments

Custom Group reserves the right to update these terms in compliance with legal and regulatory changes. Updates will be communicated electronically or via public posting on the website.

Acknowledgment

By placing an order, the Customer confirms acceptance of these terms and acknowledges their understanding of their obligations.
